Terms and Conditions
Section 1 Scope
These Terms and Conditions apply to all contracts concluded between Raceready.bike GmbH, hereinafter referred to as the seller, and the customer via the online store at www.raceready.bike.
Deviating, conflicting or supplementary terms and conditions of the customer shall not become part of the contract, even if known, unless their validity has been expressly agreed.
Section 2 Conclusion of contract
The product presentations in the online store do not constitute a binding offer, but an invitation to submit an offer.
By clicking the Add to Cart button, you place products in the cart without obligation. By clicking Place Order you submit a binding purchase offer.
The offer is accepted by sending an order confirmation by email or by delivering the goods. The purchase contract is only concluded upon that acceptance.
Section 3 Prices and payment terms
All prices are final prices in euros and include the statutory value added tax.
Shipping costs are shown separately and are not included in the product price. Orders above EUR 99 are shipped free of charge within Germany.
Payment can be made by credit card, PayPal, Sofort or bank transfer. In the case of advance payment, the amount must be transferred within 7 days of order receipt.
Section 4 Delivery and delivery times
Delivery is made to the delivery address specified by the customer. We deliver within Germany as well as to selected European countries.
Standard delivery times within Germany: 2-4 business days.
For special orders or items not in stock, delivery time may vary.
We are entitled to make partial deliveries where this is reasonable for the customer.
Section 5 Retention of title
The delivered goods remain our property until full payment has been made.
Section 6 Warranty
The statutory warranty rights apply. The limitation period for defects in new goods is 2 years from delivery.
For used goods, the warranty period is 1 year from delivery where the customer is an entrepreneur. A limitation to 1 year does not apply to consumers.
If the defect is due to a design, production or material fault, you may choose repair or replacement.
Section 7 Limitation of liability
We are liable without limitation for damages arising from injury to life, body or health as well as for damages caused intentionally or by gross negligence.
In the event of slightly negligent breaches of essential contractual obligations, our liability is limited to the foreseeable damage typical for the contract.
Otherwise, liability for slightly negligent damages is excluded.
Section 8 Returns and return shipping
Please refer to our withdrawal policy for information on your right of withdrawal.
For returns, please use the enclosed return label or contact our customer service at returns@raceready.bike. Please pack the goods securely and include the return slip.
Sale items are excluded from exchange and return unless a statutory right of withdrawal applies.
Section 9 Dispute resolution
The former EU Online Dispute Resolution platform has been discontinued. In case of disagreements about an order, please contact us directly first via the contact details listed in the imprint.
We do not participate in dispute resolution proceedings before a consumer arbitration board.
Section 10 Applicable law and place of jurisdiction
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn.
The place of jurisdiction is Munich, provided the customer is a merchant or a legal entity under public law.
